Amending a Return or Filing Prior-Year Returns: Form 1040-X, Refund Deadlines and Catch-Up Filing (2026)
Fix a filed return with Form 1040-X (recent years can be e-filed). Refund claims must be filed within 3 years of filing or 2 years of payment; an unfiled 2023 return's refund expires April 15, 2027. North Carolina amendments are due within 6 months.

The short answer
To fix a federal return you already filed, use Form 1040-X. Recent years can generally be e-filed with tax software; the IRS says amended returns for tax year 2021 or earlier must be filed on paper. To get money back, you must file within 3 years of filing the original return or 2 years of paying the tax, whichever is later (IRC §6511), and an unfiled 2023 return must be filed by April 15, 2027 to claim its refund. North Carolina residents who change their federal return generally must amend Form D-400 (with Schedule AM) within 6 months.
Who this applies to
People who received forms after filing: a corrected 1099-B, a late K-1, or a W-2c.
People who missed a benefit: an education credit, a child tax credit, or, for 2025, one of the new Schedule 1-A deductions added by P.L. 119-21, such as the extra $6,000 deduction for taxpayers age 65 or older.
Families and owners who fell behind: new immigrants who never started filing, restaurant or nail salon owners who postponed returns during busy years, and people with income or accounts in China that were never reported.
People holding an IRS letter: for example a CP2000 proposing additional income.
Amending with Form 1040-X
One Form 1040-X per year, with a clear explanation and every changed schedule attached.
How to file: The IRS requires paper for tax year 2021 and earlier, and also when you filed this year's original return on paper and are amending a prior year. Otherwise you can e-file through software; a preparer e-filing for you needs a signed Form 8879.
What to attach: Part II of the form explains the change. Attach every changed form or schedule (Schedule C, Schedule E, Form 8949 and so on); the IRS returns incomplete amendments.
Processing: Allow 8 to 12 weeks, sometimes up to 16. Status appears in "Where's My Amended Return?" about 3 weeks after you submit, for the current year and 3 prior years.
Interest and penalties: If you owe, pay as soon as possible. You do not compute interest or penalties on the 1040-X; the IRS bills them.
Filing status: In general you cannot switch from married filing jointly to married filing separately after the original due date. Going from separate to joint is generally allowed.
Deadlines: the 3-year / 2-year rule
Refunds expire. There is no matching safe harbor for unfiled years, because the assessment clock never starts on a return that was never filed.
Refund claims (§6511): within 3 years of filing the original return (including extensions) or 2 years of paying the tax, whichever is later. A return filed early is treated as filed on the due date.
Lookback cap: A claim filed within the 3-year window can generally recover only tax paid in the 3 years before the claim, plus any extension period. Withholding counts as paid on the return's due date.
Longer windows: Foreign tax credit claims generally have 10 years; bad debts and worthless securities generally 7 years; federally declared disasters may add time.
Unfiled returns: To recover withholding or estimated payments, file the original return within 3 years of its due date. After that, the refund is forfeited.
When not to amend
Math errors: The IRS usually corrects these when it processes the return and sends a notice. If the IRS already fixed it, no 1040-X is needed.
A missing form: If the IRS accepted the return without a schedule, it generally writes to ask for it. Respond to the letter.
Penalty and interest refunds only: Use Form 843.
A joint refund taken for a spouse's debt: Use Form 8379 (injured spouse), not Form 1040-X.
Original not yet processed: Do not mail a second original return. It can delay your refund.
CP2000: respond or amend?
A CP2000 is a proposal based on third-party information returns, not a bill. Reply by the date on the notice.
You agree and have nothing else to change: Follow the notice instructions. No 1040-X is needed.
You agree and have other items to report: File Form 1040-X, write "CP2000" at the top, and send it with your response.
You disagree: Explain on the response form and attach proof, such as cost basis records or evidence the income belongs to someone else. If you don't respond, the IRS may send another notice and a bill.
Catching up on several missing years
Start with the IRS's own records, then file year by year. Internal IRS policy normally looks back six years, but cases differ.
Get transcripts: Your IRS online account shows each year's Wage & Income transcript, listing the W-2s and 1099s the IRS already has.
How many years: IRM 1.2.1.6.18 (Policy Statement P-5-133) says enforcement of delinquent returns normally covers no more than six years, with managerial approval required to go further. Fraud or other facts can extend it.
Substitute for return: If you never file, the IRS may prepare a return for you. It usually leaves out deductions and credits you were entitled to.
Overseas income and accounts: If the missing years involve income, deposits or investments in China, information returns such as the FBAR and Form 8938 must be handled at the same time. See our guide on the IRS catch-up programs for overseas income and accounts.
North Carolina amended returns
North Carolina has no separate amended form: use that year's Form D-400, fill in the "Amended Return" circle, and attach Schedule AM to the front.
Six-month rule: If you voluntarily amend your federal return and your North Carolina tax goes up, file the state amendment within 6 months of the federal one. If the IRS changes your return, report it within 6 months of receiving the IRS report.
State refund window: the later of 3 years after the due date or 2 years after payment; with a valid extension, 3 years from the extended due date.
Attachments: the federal 1040-X and changed schedules, any IRS audit report, and any Schedule S, Schedule A, Schedule PN or D-400TC you filed originally, even if unchanged.
A simple example
Simplified, with round numbers and state tax ignored.
Ms. Wang works in Cary. In 2023 she earned $60,000 in wages with $6,500 of federal withholding, but she moved that year and never filed. Her correct 2023 tax is about $4,500, so she is owed $2,000. She must file her 2023 Form 1040 by April 15, 2027, or that refund is gone.
She also realizes she missed an education credit worth about $1,000 on her 2024 return, which she filed on April 15, 2025. She has until April 15, 2028 to file a 2024 Form 1040-X, and she should amend her North Carolina D-400 as well.
Common mistakes
"I can claim an overpayment whenever I remember." The 3-year / 2-year deadline is strict.
"The IRS hasn't contacted me, so the missing years are fine." The assessment clock hasn't started, and penalties and interest keep adding up.
"A CP2000 means I must file a 1040-X." Often a response to the notice is enough.
"Fixing the federal return is all I need to do." North Carolina expects the state amendment within 6 months.
"Amending triggers an audit." An amendment is not an audit. A supported correction you make yourself is usually easier to resolve than one the IRS finds.
What to do and when
Now: Gather each year's returns, W-2s, 1099s and IRS letters, and pull Wage & Income transcripts from your IRS online account.
By December 31, 2026: List the years that need amending or filing, starting with refund years closest to expiring.
April 15, 2027: Last day to claim a refund on an unfiled 2023 return (general rule; disaster relief may extend it). Also the 2026 filing deadline.
Within 6 months of a federal change: File the North Carolina amended D-400.
About 3 weeks after filing: Track the amendment online. Typical processing is 8 to 12 weeks.

Questions this article answers
Can I e-file Form 1040-X?
Yes for recent years, using tax software. The IRS says amended returns for tax year 2021 or earlier must be filed on paper, and paper is also required if you filed this year's original return on paper and are amending a prior year. Processing usually takes 8 to 12 weeks.
How long do I have to claim a tax refund?
Generally 3 years from the date you filed the original return or 2 years from the date you paid the tax, whichever is later (IRC §6511). For a return never filed, you must file within 3 years of its due date to receive the refund. Foreign tax credit claims generally have 10 years.
I haven't filed taxes in several years. How many years do I need to file?
The IRS policy statement P-5-133 in the Internal Revenue Manual says enforcement normally covers no more than six years, though fraud or other facts can extend it. Pull your IRS Wage & Income transcripts first, then file year by year, starting with refund years close to expiring.
Do I need to file an amended return for a CP2000 notice?
Not if you agree and have nothing else to change; just respond as the notice instructs. If you also have other income, credits or deductions to correct, file Form 1040-X with "CP2000" written at the top and send it with your response.
Do I need to amend my North Carolina return too?
Usually yes. North Carolina requires an amended D-400 within 6 months of a voluntary federal amendment that increases state tax, or within 6 months of receiving an IRS report of changes. Mark the Amended Return circle on Form D-400 and attach Schedule AM.
