新教育捐赠税收抵免 / Education Freedom Tax Credit — 2027 Section 25F — YCL Accounting & Consulting

1. Bottom line

Starting in 2027, eligible individuals making qualified cash donations to scholarship granting organizations (SGOs) may claim a federal Section 25F credit. The annual maximum is $1,700 per person. Under the proposed rules, joint filers could reach $3,400 through each spouse’s own qualifying contributions. Actual benefits depend on contributions, available tax liability and other limits. IRS announcement

2. What changed?

Treasury and IRS released proposed and companion temporary regulations on October 1, 2026. Both are public-inspection documents scheduled for October 2 publication. The proposals are not final; temporary rules address administrative preparations. Reliance on proposed rules for qualifying 2027 contributions requires applying the relevant provisions fully and consistently. Proposed regulations

3. Credit, deduction or scholarship?

A credit reduces tax; a deduction reduces taxable income. This credit is nonrefundable: amounts beyond available tax liability are not paid out as a credit-generated refund. Eligible unused credits may carry forward for five years. The contribution portion used for this credit cannot also generate a federal charitable deduction. Statutory background

Donors claim credits. Families apply separately to SGOs for scholarships.

4. Before donating

Confirm eligible U.S. citizen or resident status

Check the organization’s SGO qualification and IRS listing for the relevant year; ordinary charity status alone is insufficient. SGO requirements

Designate the payment for Section 25F when donating; retain payment and acknowledgement records

Document each spouse’s contributions when seeking two individual limits

Estimate usable tax liability and review related state credits

Choose an affordable donation amount even if using the credit takes longer than expected.

5. A simplified example

Assume an eligible donor contributes $1,700 in 2027, receives no related state credit and meets all requirements. With only $1,000 of tax liability available for this credit, $1,000 is used currently and $700 follows carryforward rules, rather than producing an immediate $700 refund. Other credits and ordering rules affect the actual return.

6. Timeline

2026: verify rules, budget and eligibility; a 2026 donation does not become a 2027 contribution

January 1, 2027: qualifying contributions begin

State transition deadlines: advance election by January 1, 2027; SGO list by February 15. Temporary regulations

2028: generally claim 2027 contributions on the 2027 return. Treasury FAQ

7. Planning with YCL

Bring projected income and tax liability, filing status, the proposed recipient and state-credit information. YCL can discuss contribution planning, documentation and federal-state coordination. Review the arrangement before paying rather than discovering documentation problems at filing time.

8. Common questions

What if my state does not participate? Eligible donors may support qualifying SGOs in another participating state. IRS guidance

Can I direct the scholarship to my child? Contributions cannot be earmarked for a particular student. Paying your child’s tuition directly is not a qualified SGO donation.

Is a scholarship guaranteed? No. Student eligibility generally requires public-school enrollment eligibility and prior-year household income within 300% of area median income, adjusted for family size. Awards also depend on SGO review and funding. Ask the SGO about applications. Official FAQ
