Giving Up a Green Card or Citizenship (Exit Tax)

Abandoning a long-held green card or renouncing citizenship can trigger the expatriation tax. We test whether you are a “covered expatriate”, plan around it and file Form 8854.

What is included

  • Long-term resident test (8 of the last 15 years)
  • Covered-expatriate tests: net worth, average tax liability and certification
  • Mark-to-market exit tax projection
  • Dual-status final return and Form 8854
  • Planning gifts, sales and retirement accounts before the expatriation date

Timing is everything

The tests are applied on the expatriation date, so the year you leave and what you do before it can decide whether the exit tax applies at all. Missing Form 8854 alone can make you a covered expatriate.

Common questions

Does simply moving away end my U.S. tax obligations?

No. A green-card holder stays a U.S. tax resident until the status is formally abandoned, for example with Form I-407.
